Some guy rear ends you and his freaken insurance (Progressive) agrees to repair the car, then says they won't and wants to rip you off so they can make more money by totaling then selling your car.
Let's start from the beginning. April 6, 2006, 7:50AM Central Time Zone; I'm sitting in my car at a yield sign getting ready to turn right, yielding a semi truck because his light is green and mine is red. Next thing I know, WHAM my car gets rear ended right in the center of my rear bumper. All my coins fly out of my coin compartment and over half the water in my cup decides it wants to sit on my shift boot. The guy admits that it was his fault and we get the insurance details worked out. The guy was obviously trying to cut off the semi so he could save .5 seconds off of his morning commute. He told me he didn't see me and was watching the truck, so that means he didn't even step on the brakes, I didn't hear a squeal or anything.
Fast forward to earlier this week, I get a rental car and what a punch in the face; it's a 2005 Chevy Malibu. Progressive is paying for it, but won't pay for the insurance of the car, another punch in the face. Oh yeah, I forgot, the original estimate for the repairs via the oh so experienced agent, $385, that's actually the first punch. Tuesday, the agent goes to look at the car and tells the shop to hold off on fixing the car. In the end, they won't repair my car because they underwrote the value. They originally wanted to give me $2000 for the car and they'd keep it. Eventually they agreed to giving me $2900 for the car and I had to buy it back for $800. And thus the final punch is dealt to my face.
The repairs were estimated to $2400, but the shop estimated $2200. The whole rear is pushed in pretty good. The rear impact beam is crap now and my trunk bed is pushed in slightly. The rear quarter panels on both sides are slightly rippled inwards from the impact as well. The bumper has no cracks, but looks horrible still. My license plate, mushed, but usable I suppose.
My car's a 95 and my engine has roughly 93000 miles. The body is in good condition too, handwashed only, no gas station car washes for me. I'm so ticked off, it doesn't even seem worth it to keep my car anymore. All I wanted was for Progressive to fix my car back to "perfect" condition. Curse Progressive and people who don't know how to drive cars!
damn that sucks your ride looks tight too. Whats your ins. company have to say about this? I'd contact them and tell them what progressive is trying to do. See what they say. Thats what I'd do.
Yeah I'll let you guys know how things turn out. I should contact my insurance though too. I feel like the only other option left is a lawsuit, and that in itself is such a major hassle.

Threaten getting a lawyer. You shouldn't be treated like this, thats some shady dealings. Go have a conference with his insurance company and lay down the law. They have to pay for any expenses incurred including insurance for a rental car. They also need to pay the value of the car. Otherwise insurance companies would just throw out 500 bucks and call it a day. Call them on their shit and threaten legal action.
Thanks for the support guys. Oh I'm not in Socal, I live in MN. The wing looks to be fine though. I guess I'm somewhat lucky my car was lowered though, if it was at stock height, my trunk would be sticking up in the air.
Well I was talking to some family members and other folks. Apparently I can't do much anymore. The lawsuit would cost way more than it's worth. Seriously I can't believe Progressive was really going to total my car for $2000 and keep it. Where would I find a car in my condition for $2000?
I guess I have to suck it up and fix it cheap myself, then maybe in a couple years I'll get it completely fixed with straightening the unibody side rails (which the shop said was rippled, but didn't have any kinks) at a shop and completely replacing the rear impact beam.
Dang this sucks so much. I always imagined cruising in my car for a long time and finally having the engine crap out on me. I never imagined the frame being compromised in the process without a complete fix. I could take the $2000 and toss in some more money to get it 100% repaired, but Progressive should have done it!
Well after much contemplating and heart wrenching decision making, I've decided to part with my car. I REALLY wanted to drive my car until the engine finally crapped out on me, but it seems the driver of that Ford Taurus had other ideas in mind.
I got a rear impact beam for free from my brother's friend. He bought a 97 Integra recently and only wanted the engine so he let us take it. As for straightening the frame, I'm not sure, it still drives pretty straight. I think it costs around $200-300 to straighten the frame from the estimate. It was listed as 3 labor units.
I have a cousin who's willing to buy it as is (I still plan to paint the rear bumper and stuff). And my friend also told me that he needs a car soon. But yeah, that's everything I suppose. I don't know what I want to buy, but it's not going to be an Integra, because I might as well just keep mine instead.

man that sucks dick soo bad. i've never been through this, or got into an accident so i've never had to deal with insurance companies and shit, and always thought that if it was someone else's mistake, everything would get taken care of...but apparently not. progressive sucks

this whole ordeal had me call my insurance company ask some questions n stuff, mine was estemated at 3200 and if mine got totaled they would try and find me another teggy and pay the difference if it was 500 more or so. also progressive, gieco, ect those insurances are rated for crap. when my dads van got rear ended and he wasnt even home, they had it towed and fixed,no raising his insurance nothing, was back on the street in 3 days....so im not sure but id pay the extra 40.00 and go with somone else, i love allstate and i know my rep by name ect ect.....just makes me so sad to see a ruined teggy. hey ur bro bought a 97 for the engine right>? well swap bodies? with urs and u should be good to go right?

One thing that Ive done in the past which yielded a higher pay out was find a few comps from the area thats similar to your car as far as condition and milage goes and use that to level out the price.
Thanks for the support so far. I can't really find a decent car for a good deal yet, so I'm still stuck with my car for the time being.
Yeah I thought things would always pan out in my favor too if someone hit me, but I guess I was wrong.
I can't swap it with the 97 because it was actually a car that got stolen and ditched in the woods for a few years. So basically it's pretty rusted up and most of the parts aren't even good enough to salvage. My brother's friend traded a motor for the whole car and later found out the car was pretty much worthless (including the motor) and junked it.
I've given up on trying to get more money from Progressive, they'll just find a way to scam me or something. I wish Progressive would have found me a similar car and traded it with me, however, that is the initial reason why they agreed to give $2900 versus the original $2000. I seriously don't want to ever deal with them again.
