Well I made a very bad choice last weekend. I had wayyy way way too much drink and was out of my element when my friend got pulled over. They were giving him roadside tests and I was yelling at him trying to help him understand he didnt have to submit or blow in a breathalizer. well cops didnt appreciate this and I got arrested for obstructing official business, a 2nd degree misdemeanor. I also got consuming alcohol in a moving vehicle and open container. Well I did get what I deserved but now my dad's making it a big deal saying its punishable of 90 days in jail and a 750 dollar fine. I do not want to be incarcerated, I have been arrested before 2 years ago for dui. I was wondering if I should get legal help or if I should just plead no contest and talk to the judge.

Depends on whether getting a lawyer is something you can easily afford. I wanted to get a lawyer for my last DUI, but couldn't afford one. I got a court-appointed and it was pretty worthless; I would've had the same result regardless. You can try talking your way out of it, but considering what you got charged with I wouldn't expect a whole lot of lenience. I doubt you'll get jailtime though, that's a lil harsh. I did five days for my 2nd DUI, but that's way different than what you're dealing with...in my opinion. Whatever you do, good luck to you; I hope this teaches you a lil lesson about talking shit to cops

If you can afford a lawyer get one. But if you can't you're pretty much aced out.

and btw, when you get your license. You sign a form that says that if you do not submit to roadside tests, that your license is automatically suspended regardless of the outcome of your case.

lawyer whether its one you paid for or one appointed by the court is always better than no lawyer, especially with a criminal case IMO.

you got lucky i got 1 and only 1 DUI it is now 3 years later, i am still on probation, i served 10 days in jail, and have paid out the ass in fines, court apppointed madd classes, etc... shits not fun

Well the consequences are different in different districts, plus it depends on whether you had any priors, how the arrest itself transpired, etc. It was my second DUI and my third arrest in less than two years (all alcohol related.) However, my last arrest was in a different district than the first two so they didn't look into my previous offenses. Which was good because I was still on diversion for my first DUI when I got the second, so it should have violated my diversion and sent me to jail. Instead, I got my diversion completed for the initial DUI and was placed on probation and had my license suspended for a year for the second. I did 5 days in jail and have 175 more hanging over my head to remind me not to mess up again, plus court fines of $1500ish, random UAs and I go to AA.

sounds about like mine, i had to go to 52 hours of alchohol education, 52 hours of therapy, a MADD class, been on probation for 2+years @$50 a month 48 hours community service @$80, 10 days in jail @$200...yes in colorado you have to pay to go to jail :bash and still had my attourney fees, and other court fees on top of that, as well as losing my liscence......DUI's fucking SUCK and that was my only one, i didnt harm anyone or really do anything wrong...i got pulled over cause i did a rolling stop, and when i turned onto the next street i crossed a lane to get into the second lane insted of turning into the first lane...the cop was parked outside of the parking lot of the bar i was at.....can we say cherry-picking??

The won't lock you up for 90 days. Get a lawyer. You might get some probation and sent to classes but no jail time plus if your lawyer is any good they will drop the open container charge.

I went through the same thing, luckily mine was in West Virginia (Charlestown to be exact, 1 mile from the casino). I got hit with underage consumption and open container in a vehicle. If I wasn't so mouthy (wasted) and stupid I probably would not have gone to jail. But anyway, I spent alot of the night in there. A friend of mine left the casino to come get me when I was allowed to go (3am and still wasted, that's why I love WV) then we went back to the casino to meet the rest of the people we were going with and I even cracked a beer in the parking garage. I paid $200 that night and all was forgiven, thank god it wasn't in Virginia, I'd probably still be in jail.

well yeah i know i fucked up but to sit outside a bar and wait for someone to do a rolling stop and then merge into a street cutting across 1 lane to hit the second ( which most people do regularly) and find that as means to pull them over for DUI suspicion is just cherrypicking i guarantee that same officer wouldnt have pulled that shit at noon as opposed to 2 am WHEN THE BARS CLOSE.... either way, yes it was me that fucked up i was in the wrong

we have this "lawyer" here in san antonio. he calls himself the "dwi dude" and pretty much tells everyone who see's his commercials or heard them on the radio to refuse a brethalyzer and say "you want to speak to the dwi dude!"

some things we have i disagree with... but others i am glad i live here....no ban on "assault" rifles i can carry my AR, i can walk into most any place with a pistol in a holster on my hip ( not that i do), with the proper permits i can own an MP5 or any class 3 weapon.....we are pretty free in colorado, but when it comes to drinking and driving they crack the fuckin whip :bash

In Florida it say on the license that you understand that you will submit to a alcohol test by accepting that license. It actually says it on the license. You don't get a lawyer in Florida. Because its on there and we are not asking any incriminating questions, Miranda or a lawyer is not needed.
